Under the current Excise Act it is legal to own a still of less than 5 litre capacity, providing you don't use it for the distillation of ethanol. What it doesn't say (and I can't find anywhere) is how the 5 litre capacity is measured. Does it include the headspace or is it just the capacity of the pot etc.

Any clues on this with all you guys busy stilling your Essential Oils?
 
Dunno but everyone I know with a water purifier has one with a 5L boiler which they say keeps them legal if that helps?

Currently trying to fathom the Excise act since the old distillation act has been repealed. was hoping there may be someone out there in the legal profession with an insight to it.
