I have a tap like this one that leaks sometimes, from underneath - liquid gets in through the orange seal.

It happens if I tilt it a bit too high up, which can be while inserting the bottle filler or hose for kegging, or just opening the tap slowly to fill the hydrometer tube.

the real problem is that once liquid gets in, it keeps on leaking!

Is it a buggered seal and should be replaced? Or is this just a design flaw?

(I only found out yesterday I should be putting oil on the ring when using it)
 
Can't help you with the leaking but be careful about what sort of oil you use. Grab some foodsafe keg lube from your LHBS.
 
I've read their original fermenter taps for the krausen collar fermenters could leak (I have one myself, it'll drop a few ml over a brew). To fix, soak in olive oil overnight then wash off. Apparently it soaks into and swells the rubber slightly.
 
I have this problem from the same tap. I put a few rounds of teflon plumbers tape on the seal. I've also put a zip tie around the "spout" that the tap slips into to hold it tight. That stopped the drips, but the keg lube suggestion sounds good.
