Not if the problem has been acknowledged by Nintendo (years ago) and no attempt has been made to rectify the situation.
You still go to gaol for manslaughter.
Again: not that I believe that Nintendo should have to do anything about it. I just don't happen believe for a second that they did not know this was going to happen prior to release. As if no one at Nintendo would have checked their region locking with a different region disc - not a snowflake's.
