under beeer styles and extreme beers they have:

triple bock... 18% ABV
Utopia... 25% ABV
millenium... 20%

Damm straight, the stuff is much more dangerous than a postal worker with an AK47.
 
I think that you will find something like 18 out of the 20 strongest beers in th eworld are all from the US, and none of em are under 16%. I know a friend that has had Utopias and thought it was excellent. Mind you, at $USD125 for a 12oz bottle (330mL odd), it had wanna be! In response to the "can you call it beer" question. My mate said the closest thing he could compare it to is tokay, though it is still different to that. I guess they can call it beer cause it is made from malt (and alot of dextrose incrementally fed), boiled with hops, and fermented with Saccharomyces. Not what one would usually call beer, but still beer by definition.

EDIT - I am fairly sure that the reason it cannot be sold in those states, is that they have alcohol restrictions on stuff called beer, as in it cant be sold if over a certain %age. I know that north carolina recently lifted its "cap" from 6% to 15%, hence why it is still on the Banned list - as the beer is 25%. T.
